Judge Sends BTJW Case to Trial on All Claims

August 2, 2018 – This week, attorneys Kaarin Nelson Schaffer and Dustin Massie received a sweeping order from a Ramsey County judge in the case of Char Weber v. Century Link, Inc., et al., 62-CV-17-499 (D. Ct. Minn. July 31, 2018). Ms. Weber brought claims against CenturyLink under the Minnesota Human Rights Act for age and gender discrimination, as well as retaliation. She also brought a claim against her former supervisor for tortious interference with her employment contract. The case was filed in Ramsey County in January 2017. Defendants filed a motion for summary judgment seeking to have the case dismissed and prevent Ms. Weber from her right to a jury trial. Judge Frisch denied the motion in its entirety finding that Ms. Weber “establish[ed] genuine and material disputed facts surrounding the circumstances of the allegedly illegal and tortious behaviors, [and that] [t]he existence of these material fact issues . . . [we]re fatal to Defendants’ motion for summary judgment on each of the counts set forth in the Complaint.” The case is set for jury trial in late-November or early-December.
