Joni Thome served as faculty presenters at the 2013 Upper Midwest Employment Law Institute. The two-day Institute is one of the largest employment law conferences in the nation, full of educational programming and training seminars for employment attorneys and human resources professionals. It is co-sponsored by Minnesota CLE, the Minnesota State Bar Association’s Labor and Employment Law Section, and the Twin Cities Human Resource Association.

Thome, along with defense colleague Kathryn Mrkonich Wilson of Littler Mendelson, presented “Cutting-Edge Issues in Discrimination – Caregiver, Marital Status and Appearance.” The panel discussed the claims and defenses in these developing areas of employment litigation. With new case law surfacing on these forms of employment discrimination, this timely presentation provided practical advice on spotting these claims and litigation tips on how to manage them.

Drawing from recent FMLA decisions and their litigation experience, the panel of employment lawyers discussed the challenges and prospects in litigating a case under the Family and Medical Leave Act. The panel specifically addressed FMLA hot topics, including: the interplay between FMLA and disability discrimination claims, recent case law regarding notice, developments in interference claims and the 2013 amendments to the FMLA.
